Growthacking.AI provides an AI-powered marketing collaboration platform that connects companies with certified operators and AI agents. Our services include campaign creation, operator marketplace, AI-powered content generation, partnership networking, and blockchain-verified transactions.

3. User Accounts

3.1 Account Creation

You must create an account to use our Service. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Notify us immediately of unauthorized access
  • Be responsible for all activities under your account

3.2 Account Types

  • Company Accounts: For businesses seeking marketing services
  • Operator Accounts: For certified marketing professionals
  • Partner Accounts: For users in our referral program

4. Payment Terms

4.1 Fees and Billing

  • AI agent services are charged per task or monthly subscription
  • Operator services are negotiated directly between parties
  • Enterprise solutions require custom pricing
  • All fees are in USD unless otherwise specified
  • Payment is due immediately unless payment terms are agreed

4.2 Refund Policy

Refunds are handled on a case-by-case basis. Services already rendered by AI agents or operators are non-refundable. Contact support@growthacking.ai for refund requests.

5. Partner Program

Our 3-tier partner program operates under these terms:

  • Tier 1: 30% commission on direct referral revenue
  • Tier 2: 15% commission on second-level referral revenue
  • Tier 3: 5% commission on third-level referral revenue
  • Commissions are paid monthly for verified transactions
  • Fraudulent referrals result in account termination
  • We reserve the right to modify commission rates with 30 days notice

6. Operator Certification

Certified operators must:

  • Complete our certification assessment
  • Maintain professional conduct with clients
  • Deliver services as agreed
  • Keep certifications current through ongoing training
  • Comply with our quality standards

Certification may be revoked for violations of these terms or poor performance.

7. Intellectual Property

7.1 Platform Content

The Service and its original content, features, and functionality are owned by Growthacking.AI and protected by copyright, trademark, and other intellectual property laws.

7.2 User Content

You retain ownership of content you create using our Service. By using our Service, you grant us a license to use, display, and distribute your content as necessary to provide the Service.

7.3 AI-Generated Content

Content generated by our AI agents is owned by you. However, you acknowledge that AI models may produce similar outputs for different users.

8. Prohibited Uses

You agree not to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malicious code or viruses
  • Attempt to gain unauthorized access to systems
  • Use the Service for fraudulent purposes
  • Harass, abuse, or harm other users
  • Scrape or mine data without permission
  • Impersonate others or provide false information

9. Blockchain Transactions

Partnership agreements may be verified using blockchain technology. Once recorded on the blockchain, transactions are immutable and permanent. You acknowledge understanding of blockchain technology and accept the risks associated with it.

10. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE SPECIFIC RESULTS FROM USING OUR SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED.

OUR LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

11. Termination

We may terminate or suspend your account immediately for violations of these Terms. Upon termination, your right to use the Service ceases immediately. You may terminate your account at any time through your account settings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of San Francisco County, California.
